TERMS OF SERVICE FOR THE ‘AI MODULE’
Maticad s.r.l. — Version: 1.1 Valid starting from July 9, 2026
1. Introduction
These Terms of Service ("Terms") govern the access to and use of the AI Module (“Module”, “Service”) optionally available in the DomuS3D desktop software platform ("Software") provided by Maticad s.r.l. ("Company", "we", "us", "our").
By installing, accessing, or using the Software and the Service, the user ("Customer", "User") agrees to be bound by these Terms.
If the User is accepting these Terms on behalf of a company or other legal entity, the User represents and warrants that they have the authority to bind such entity.
2. Description of the Service
This document describes the Terms of Service related to the specific Module of the Software called ‘AI Module’. The AI Module is not included in the standard license of the Software. The AI Module contains several features powered by AI, and also enables professional users, including architects, interior designers, and related professionals, to generate and process photorealistic interior environment imagery using artificial intelligence technologies.
Note that certain functionalities may be powered by third-party AI infrastructure providers.
3. Professional Use Only
The Software is intended exclusively for professional and commercial use.
The Software is not intended for minors or consumer-oriented use. It is the User’s responsibility to take all actions to prevent minors using the Service.
4. Artificial Intelligence Disclaimer
The Software uses generative artificial intelligence systems that may produce inaccurate, incomplete, inconsistent, or unexpected outputs.
Generated content is provided for creative and visualization purposes only and shall not be considered:
- engineering advice,
- architectural certification,
- regulatory compliance documentation,
- structural analysis,
- legal advice,
- or professional safety validation.
In accordance with Art. 50 of Regulation (EU) 2024/1689 (EU AI Act), where the User makes AI-generated content public or uses it in communications addressed to third parties, the User must ensure that such content is clearly marked as being artificially generated or manipulated. The User shall not remove, obscure, or alter any technical watermarks or metadata applied by Maticad to identify the AI-generated nature of the content.
Users remain solely responsible for reviewing, validating, and approving all generated outputs before any commercial, technical, construction, or operational use.
5. User Responsibilities
Users agree not to:
- upload unlawful or infringing content;
- attempt to reverse engineer the Software;
- use the Software to generate illegal, deceptive, defamatory, or harmful material;
- use the Software in violation of applicable laws or regulations;
- submit personal data, sensitive personal data, or confidential third-party information unless expressly authorized.
Users are solely responsible for all content submitted to the Software.
If a user wishes to raise an objection regarding the suspension or limitation of the Service, he/she has a maximum of 15 (fifteen) days to notify the objection via certified email (info@pec.maticad.it).
In the event of a justified and timely objection, Maticad will evaluate the restoration of credits or services on a case-by-case basis, without prejudice to the User's right to seek all remedies provided by applicable law, including judicial remedies.
6. AI Module prohibited use policy
Generative AI models can help you explore, learn, and create. We expect you to engage with them in a responsible, legal, and safe manner. The following restrictions apply to your interactions with generative AI in the Maticad products and services that refer to this policy.
- Do not engage in dangerous or illegal activities or otherwise violate applicable law or regulations. This includes generating or distributing content that:
- Relates to child sexual abuse or exploitation.
- Facilitates violent extremism or terrorism.
- Facilitates non-consensual intimate imagery.
- Facilitates self-harm.
- Facilitates illegal activities or violations of law -- for example, providing instructions for synthesizing or accessing illegal or regulated substances, goods, or services.
- Violates the rights of others, including privacy and intellectual property rights -- for example, using personal data or biometrics without legally-required consent.
- Tracks or monitors people without their consent.
- Makes automated decisions that have a material detrimental impact on individual rights without human supervision in high-risk domains -- for example, in employment, healthcare, finance, legal, housing, insurance, or social welfare.
- Do not compromise the security of others’ or third-party services provided within the Service. This includes generating or distributing content that facilitates:
- Spam, phishing, or malware.
- Abuse of, harm to, interference with, or disruption to Maticad’s or others’ infrastructure or services.
- Circumvention of abuse protections or safety filters -- for example, manipulating the model to contravene our policies.
- Do not engage in sexually explicit, violent, hateful, or harmful activities. This includes generating or distributing content that facilitates:
- Hatred or hate speech.
- Harassment, bullying, intimidation, abuse, or the insulting of others.
- Violence or the incitement of violence.
- Sexually explicit content -- for example, content created for the purpose of pornography or sexual gratification.
- Do not engage in misinformation, misrepresentation, or misleading activities. This includes:
- Frauds, scams, or other deceptive actions.
- Impersonating an individual (living or dead) without explicit disclosure, in order to deceive.
- Facilitating misleading claims of expertise or capability in sensitive areas -- for example in health, finance, government services, or the law, in order to deceive.
- Facilitating misleading claims related to governmental or democratic processes or harmful health practices, in order to deceive.
- Misrepresenting the provenance of generated content by claiming it was created solely by a human, in order to deceive.
7. Abuse monitoring
If Maticad detects (or a third party provider of the service you are using, alerts Maticad of) an abuse with your prompts or inputs, Maticad is entitled retaining the following data for a period of 3 (three) months after the alert, for the purposes of detecting and preventing violations of the AI Policy and the Terms of Use you have agreed on, to maintain the safety and security of the Services, and any required legal or regulatory disclosures:
- Prompts: The text prompts you submit to the AI Module.
- Contextual Information: Any additional context you provide with your prompts.
- Output: The responses generated by the AI Module, despite the model you are working with
Maticad grants that retention of the suspected material will be held in Europe, in compliance with GDPR rules, for the sole scope of properly investigating the abuse.
8. Working with you on Policy Compliance
If your use of the Service (AI Module) doesn't align with the Maticad policies, we may take the following steps:
- Get in touch: We may reach out to you through email to understand your use case and explore ways to bring your usage into compliance.
- Temporary usage limits: We may limit your access to the Service (AI Module), specifying the models you are entitled using
- Temporary suspension: We may temporarily pause your access to the Service
- Account closure: As a last resort, and for serious violations, we may permanently close your access to the AI Module Service and other Maticad services.
9. Intellectual Property
Subject to compliance with these Terms, Users retain ownership of their original input materials and generated outputs to the extent permitted by applicable law.
In accordance with Art. 50 of Regulation (EU) 2024/1689 (EU AI Act), where the User makes AI-generated content public or uses it in communications addressed to third parties, the User must ensure that such content is clearly marked as being artificially generated or manipulated. The User shall not remove, obscure, or alter any technical watermarks or metadata applied by Maticad to identify the AI-generated nature of the content.
The Company does not guarantee exclusivity or uniqueness of AI-generated outputs.
10. Third-Party AI Services
Certain functionalities may rely on third-party cloud and AI providers.
The availability, accuracy, performance, and continuity of AI-generated outputs may depend on such third-party services.
Maticad undertakes to select its third-party AI infrastructure providers with professional diligence, applying appropriate contractual and technical criteria, and to monitor their performance levels on an ongoing basis. While Maticad cannot guarantee the continuous availability of third-party infrastructures beyond its control, it will take commercially reasonable steps to mitigate the impact of any outages, interruptions, or inaccuracies on the User. Maticad's limitation of liability for third-party failures applies exclusively in cases where the fault is attributable solely to the third-party provider and cannot be attributed to Maticad's culpa in eligendo or in vigilando, and in any event does not cover cases of willful misconduct (dolo) or gross negligence (colpa grave) of either Maticad or the third-party provider, pursuant to Art. 1228 and Art. 1229 of the Italian Civil Code.
The Company reserves the right to modify the available models, subscription prices and credit consumption rates. Such changes will be published on the support page (https://support.domus3d.com/hc/en-gb/articles/28030638514076).
11. Data Processing
The Company does not use Customer prompts or generated images to train third-party artificial intelligence models, in accordance with GDPR policy.
The Company does not intentionally collect personal data through the AI generation workflows.
Users shall avoid submitting personal data or confidential regulated information unless explicitly authorized by the Company.
12. Confidentiality
The Company will implement commercially reasonable technical and organizational measures to protect Customer content against unauthorized access, disclosure, or misuse.
13. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for:
- indirect or consequential damages;
- loss of profits;
- business interruption;
- loss of data;
- inaccuracies in AI-generated outputs;
- project delays or construction errors arising from use of generated materials.
- Availability, accuracy and performance of the available models
The total aggregate liability of the Company for any single claim or series of related claims arising out of or in connection with these Terms shall be limited to the total fees actually paid by the Customer for the AI Module during the twelve (12) months immediately preceding the event giving rise to the liability. The foregoing limitation does not apply in cases of willful misconduct (dolo) or gross negligence (colpa grave) of Maticad, nor to damages for personal injury, nor to any liability that cannot be excluded or limited by applicable mandatory law (including Art. 1229 c.c.). The present limitation of liability clauses are subject to the specific written approval requirement under Art. 1341, co. 2 c.c.
14. Compliance with Laws
Users are responsible for ensuring that their use of the Software complies with:
- applicable copyright laws;
- export control regulations;
- professional regulations;
- privacy and data protection laws;
- AI-related regulations, including the EU AI Act where applicable.
15. Way of licensing the AI Module
The AI Module, which is the subject of this document, is not available in the standard Software license. It is an optional module that has to be specifically activated by the User, contacting the Sales Team (sales@maticad.com) and activating a specific subscription.
Subscription properties are:
- Subscription may be available at different price TIERS. Subscription price has to be paid in advance upon receiving a specific order for the specific subscription from the Sales Department. Once the User has paid for the subscription, Company has up to 10 (ten) working days (*) in order to activate the subscription on the given License ID.
((*) Excluding last week of December, first week of January, and the central weeks of August). - Each TIER includes a specific number of credits to be spent while using the Services contained in the AI Module.
- Each TIER is limited in time. If, by the expiration time of the subscription, the User has not spent all the available credits, the remaining credits will be lost.
- Each subscription will be activated on a specific Software (DomuS3D) license. All credits contained in the subscriptions shall be spent in the given license. If the Software license contains multiple concurrencies (or in case of a Client-Server license with multiple users/Clients) the available credits can be spent by any Concurrency/Client, without any possibility of specifically dividing the credits among Concurrencies/Clients.
- Credits will be spent proportionally on the specific feature available in the Service. This means that each feature has been assigned a specific ‘price’ classified in credits. In case of multiple models available for Generative AI, each model will have assigned a specific cost for image generation.

The Company reserves the right to modify the terms related to the license and conditions of the Service (Terms of Service), the available models, subscription prices and credit consumption rates. Such changes will be published on the support page (https://support.domus3d.com/hc/en-gb/articles/28030638514076) and will apply to subsequent subscription renewals or new purchases.
The Company will notify the User about those changes by email, nonetheless the User is intended to check regularly the currently valid Terms of Service, Policies, Credits consumption and available models connecting to the following link:

16. Termination
The Company may suspend or terminate the access to the subscription in case of:
- violation of these Terms;
- unlawful use;
- abuse of AI systems;
- security risks.

17. Governing Law
These Terms shall be governed by the laws of Italy.
Any disputes shall be subject to the exclusive jurisdiction of the Courts of Pesaro.

AI DISCLAIMER AND ACCEPTABLE USE POLICY
Maticad s.r.l. — Version: 1.1 Valid starting from July 9, 2026
Software incorporates generative artificial intelligence technologies to assist professional interior visualization workflows.
Users acknowledge and agree that:
- AI-generated output may contain inaccuracies, inconsistencies, artifacts, or unintended elements.
- Generated imagery is intended solely for conceptual, creative, and visualization purposes.
- The Software does not provide certified architectural, engineering, legal, safety, or regulatory advice.
- Users remain fully responsible for:
- validating outputs;
- verifying compliance with applicable regulations;
- reviewing visual accuracy;
- ensuring suitability for commercial or construction use.
- complying with any applicable transparency obligations, including disclosing that the imagery was generated or modified using AI, as mandatorily required by Art. 50, par. 2 of Regulation (EU) 2024/1689 (EU AI Act), operative since 2 August 2025, which imposes machine-readable marking of all synthetic AI-generated content.
4-bis. Marking of AI-Generated Outputs – Obligations of Maticad and the User
Maticad guarantees that all visual outputs generated through the DomuS3D AI Module shall be marked, in a machine-readable format, as artificially generated content, in accordance with Article 50(2) of Regulation (EU) 2024/1689. The User shall not remove, alter, or obscure such technical marking. Where the outputs are used in commercial, promotional, or editorial contexts, the User undertakes to clearly disclose the artificial nature of the content in accordance with the requirements of the applicable legislation.
- Users shall not use the Software to:
- generate unlawful content;
- infringe intellectual property rights;
- engage in practices prohibited under Art. 5 of Regulation (EU) 2024/1689, including but not limited to subliminal manipulation, exploitation of vulnerable groups, or real-time biometric identification in publicly accessible spaces without legal authorization.
- generate offensive, deceptive or fraudulent imagery;
- violate applicable export, sanctions, or AI regulations.
- Users shall avoid submitting:
- personal data;
- sensitive information;
- confidential third-party data;
- regulated information.
In the event of accidental submission of any of the above categories of data, the User must immediately notify Maticad at info@pec.maticad.it to coordinate the necessary deletion, containment, or mitigation measures in accordance with the applicable Privacy Policy and the rights of data subjects under Regulation (EU) 2016/679 (GDPR). Maticad shall take reasonable steps to delete the accidentally submitted data from relevant processing systems without undue delay.
- Users are aware that AI services may rely also on third-party infrastructure providers.
- Maticad is not responsible for any temporary failure of its own or third-party infrastructure; for this reason, users acknowledge that it is possible to face temporary interruptions of the Services. In such a case, User declares to waive any claims for indirect damages or loss of profit arising solely from temporary unavailability of the Service caused by force majeure or unforeseeable third-party failures, except in cases of willful misconduct (dolo) or gross negligence (colpa grave) by Maticad, as mandatorily required under Art. 1229 of the Italian Civil Code.
- The Company reserves the right to suspend access for abusive, unlawful, or “high-risk usage”. For the purposes of this Policy, "high-risk usage" includes, but is not limited to:
- (i) uses that fall within the categories of "Prohibited AI Practices" listed in Art. 5 of Regulation (EU) 2024/1689;
- (ii) uses classifiable as "High-Risk AI Systems" under Art. 6 and Annex III of the same Regulation, including applications in critical infrastructure, employment, education, access to essential services, law enforcement, migration, or administration of justice;
- (iii) any intentional modification of the Software's intended purpose that would alter its risk classification under the EU AI Act.
- Human Oversight and Accountability — Users are required to maintain meaningful human oversight over AI-generated outputs, particularly when such outputs are used to support professional, commercial, or technical decisions that may impact third parties. The User shall assume full responsibility for any decision or action taken on the basis of outputs generated by the Software, without prejudice to Maticad's liability for willful misconduct or gross negligence in accordance with Art. 1229 of the Italian Civil Code. By using the Software, the User acknowledges the inherent limitations of generative AI systems and accepts the obligations set forth in this Policy, including the transparency and marking obligations under Art. 50 of Regulation (EU) 2024/1689 and the responsible-use obligations set forth herein.

PRIVACY POLICY

1. Introduction
This Privacy Policy explains how Maticad s.r.l. ("Company") processes information in connection with the use of the AI Module contained in the DomuS3D desktop application.
In particular, this privacy policy refers to the Service called AI Module; the Service is described in article n. 2 of the Terms of Service document
The Company is committed to protecting privacy and complying with applicable data protection laws, including the EU General Data Protection Regulation ("GDPR”) – Regulation (EU) 2016/679 and, to the extent applicable, Regulation (EU) 2024/1689 (EU AI Act), in particular as regards transparency and technical documentation obligations under Arts. 13, 50, and 53 thereof.
2. Categories of Data Processed
The Software is designed primarily for professional architectural and interior visualization workflows and is not intended to collect personal data through AI generation workflows. However, certain personal data are necessarily processed in connection with the provision of the Service (including account data and data that may be incidentally included in prompts), and this Policy applies to all such processing. Users retain exclusive responsibility for any personal data they voluntarily insert into the Software's input fields.
The following categories of technical data may be processed:
- account and licensing information;
- device and usage diagnostics;
- rendering prompts, generation instructions and potentially harmful content detected during security filtering;
- generated images and technical assets;
- software telemetry and crash reports.
Users are instructed not to upload:
- personal data,
- sensitive personal data,
- biometric information,
- health information,
- confidential regulated information.
3. Abuse monitoring
If Maticad detects (or a third party provider of the service you are using, alerts Maticad of) an Abuse with your prompts or inputs, Maticad is entitled retaining the following data for a period of 3 (three) months after the alert, for the purposes of detecting and preventing violations of the AI Policy and the Terms of Use you have agreed on, to maintain the safety and security of the Services, and any required legal or regulatory disclosures:
- Prompts: The text prompts you submit to the AI Module.
- Contextual Information: Any additional context you provide with your prompts.
- Output: The responses generated by the AI Module, despite the model you are working with
Maticad warrants that retention of the suspected material will be held in Europe, in compliance with GDPR rules, for the sole scope of properly investigating the abuse, on the legal basis of legitimate interest pursuant to Art. 6(1)(f) GDPR, specifically the interest in ensuring the security of the platform and preventing unlawful use of AI systems. A Legitimate Interest Assessment (LIA) has been conducted internally and is available upon reasoned request. After the 3-month period, data will be securely deleted unless further retention is required for legal proceedings or regulatory compliance.
4. Working with you on Policy Compliance
If your use of the Service (AI Module) doesn't align with the Maticad policies, we may take the following steps:
- Get in touch: We may reach out to you through email to understand your use case and explore ways to bring your usage into compliance.
- Temporary usage limits: We may limit your access to the AI Module, specifying the models you are entitled to use.
- Temporary suspension: We may temporarily pause your access to the Service
- Account closure: As a last resort, and for serious violations, we may permanently close your access to the AI Module Service and other Maticad services.
5. Purpose of Processing
Data may be processed for:
- providing Software functionality;
- generating AI-based visual outputs;
- software maintenance and security;
- fraud prevention;
- technical support;
- performance monitoring and service improvement.
6. Legal Basis
Processing is based on:
- performance of a contract;
- legitimate interests pursuant to Art. 6(1)(f) GDPR in:
- (i) ensuring platform security and integrity;
- (ii) preventing unlawful use or misuse of the AI system;
- (iii) conducting abuse monitoring — as further documented in the internally retained Legitimate Interest Assessment (LIA) available upon request;
- compliance with legal obligations.
7. AI Infrastructure Providers
Certain processing operations may rely on third-party cloud and AI infrastructure providers.
Where applicable, such providers act as processors or sub-processors under contractual data protection obligations (Data Processing Agreements compliant with Art. 28 GDPR).
The Company uses commercially reasonable measures to ensure that prompts and outputs submitted through paid enterprise AI services are not used for model training by third-party providers.
8. International Transfers
Data may be processed in jurisdictions outside the User’s country.
Where required, international transfers are protected through appropriate safeguards, namely the Standard Contractual Clauses (SCCs) adopted by the European Commission pursuant to Decision (EU) 2021/914, supplemented where appropriate by additional technical measures such as encryption in transit and at rest. Where applicable, transfers to the United States may also rely on the EU-U.S. Data Privacy Framework.
9. Data Retention
Data is retained in accordance with the following schedule, differentiated by category:

The Company implements technical and organizational security measures designed to protect data against unauthorized access, loss, misuse, or disclosure.
11. User Rights
Where applicable under GDPR or other laws, Users may have rights to:
- access data;
- correct data;
- request deletion;
- restrict processing;
- object to processing;
- request portability.
